TERMS & CONDITIONS
Effective date: September 17, 2026
NOT FOR EMERGENCIES: Lunera Health services are intended for non-emergency healthcare needs. If you believe you are experiencing a medical emergency, call 911 or seek immediate medical attention.
These Terms & Conditions (“Terms”) govern your access to and use of the Lunera Health website and related features, forms, tools, technology, communications, and services (collectively, the “Platform”).
These Terms incorporate by reference the Lunera Health Privacy Policy, Refund & Cancellation Policy, and other policies and consents presented through the Platform.
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to these Terms.
1. WHO WE ARE PLATFORM VS. MEDICAL CARE
Lunera Health provides a patient-facing telehealth technology and administrative platform through which eligible individuals may request access to healthcare services and related products and services.
Lunera Health utilizes technology and operational infrastructure provided by Rx Collective to support certain platform, telehealth-facilitation, integration, payment-processing, prescription-routing, and operational functions.
Lunera Health is not a medical provider and does not practice medicine.
Medical consultations and clinical services are provided by appropriately licensed healthcare professionals affiliated with independent professional medical entities. Healthcare professionals retain sole responsibility for medical evaluations, clinical decision-making, diagnosis, treatment, prescribing, and other clinical services.
Lunera Health does not direct or interfere with independent professional medical judgment.
Prescription medications are dispensed by independent, appropriately licensed pharmacies responsible for prescription verification, pharmacist review, dispensing, packaging, and shipment.
2. PROVIDER NETWORK
Clinical services facilitated through the Rx Collective platform are provided through an independent provider network and its affiliated professional medical entities, including:
Joseph M. Palumbo, D.O. East, P.C.; Joseph M. Palumbo, D.O., P.A.; and Joseph M. Palumbo, D.O. West, P.C.
These professional medical entities and their healthcare professionals are independent from RxCollective and Lunera Health and retain sole responsibility for clinical care and professional medical judgment, including medical evaluations, diagnosis, treatment, and prescribing.
Healthcare professionals providing clinical services through the Platform are appropriately licensed or otherwise authorized to practice in the state where the patient is located, as required by applicable law.
Additional information concerning the healthcare professional responsible for a patient’s care, including provider identity and applicable professional or licensure information, will be made available as required by applicable law.
The provider network available through the Platform may change from time to time.
3. ELIGIBILITY
You must be at least eighteen (18) years old or the age of majority in your jurisdiction and physically located in a jurisdiction where the applicable services are legally available.
You must provide truthful, accurate, current, and complete information; satisfy applicable intake and eligibility requirements; provide valid identification and location verification when required; and acknowledge applicable patient consents and disclosures.
Service availability depends on factors including location, applicable law, provider and pharmacy availability, and the requested treatment.
Eligibility to access the Platform does not guarantee eligibility for medical treatment or a prescription.
4. TELEHEALTH SERVICES & LIMITATIONS
The Platform facilitates access to licensed healthcare professionals through legally permitted telehealth modalities.
Depending on applicable law, patient location, medical circumstances, and applicable clinical protocols, services may be provided through an asynchronous assessment or another legally permitted telehealth modality.
You may be required to provide health and medical history information, complete an intake assessment, acknowledge telehealth informed consent and applicable privacy notices, provide identification, confirm your physical location, and provide additional information requested in connection with your care.
Telehealth is not appropriate for every patient or condition.
A healthcare professional may require additional information, laboratory testing, another consultation modality, or an in-person evaluation. The healthcare professional may also determine that requested treatment is not medically appropriate.
Access to the Platform, completion of an intake questionnaire, or payment does not guarantee treatment or issuance of a prescription.
5. YOUR RESPONSIBILITIES & ACCURACY OF INFORMATION
You agree to provide truthful, accurate, current, and complete information, including requested identity, location, contact, treatment, medical history, symptoms, medications, allergies, and other relevant information.
Healthcare professionals may rely upon the information you provide.
False, incomplete, misleading, or inaccurate information may result in delay, denial, or discontinuation of services and may create health risks.
You may not attempt to obtain medication through fraud, impersonation, misrepresentation, or materially inaccurate information.
6. ACCOUNTS, SECURITY & ELECTRONIC COMMUNICATIONS
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
By using the Platform and providing contact information, you agree that Lunera Health and service providers supporting the Platform may communicate with you regarding requested services.
Communications may include consultation notices, reminders, account notifications, payment and transaction notices, fulfillment updates, customer-support communications, and other service-related communications.
Communications may be delivered by email, SMS/text message, telephone, or Platform messaging. Message and data rates may apply.
Marketing communications may require separate consent and may be opted out of as described in those communications and our Privacy Policy.
7. PAYMENTS, REFUNDS & SERVICE FEES
Applicable prices and fees will be disclosed before a transaction is completed.
Charges may include consultations, Platform or service fees, prescription products, laboratory or diagnostic services, shipping, and other disclosed products or services.
Lunera Health determines the amounts charged to its customers for services offered through the Lunera Health Platform.
You agree to provide valid billing and payment information and authorize applicable charges.
Payment processing may be facilitated through third-party payment and technology infrastructure.
Refunds and cancellations are governed by the Lunera Health Refund & Cancellation Policy and applicable provider or pharmacy policies where relevant.
Certain charges may become non-refundable after services have been performed, a healthcare professional has reviewed a consultation, or medication has been dispensed, subject to applicable law.
8. PRESCRIPTIONS & PHARMACY FULFILLMENT
Only an appropriately licensed healthcare professional may determine whether prescription medication is medically appropriate.
Lunera Health does not prescribe medication.
When medically appropriate, a healthcare professional may issue a prescription in accordance with applicable law. The prescription may be transmitted to an appropriately licensed pharmacy for verification and fulfillment.
Independent pharmacies are responsible for pharmacist review, prescription verification, dispensing, packaging, counseling where required, and shipping.
A pharmacy may decline to fill a prescription where required or permitted by law or professional standards.
A prescription does not guarantee fulfillment or continued medication availability.
9. MEDICAL INFORMATION & NO GUARANTEE OF TREATMENT
Health, medication, treatment, and wellness information available through the Platform is for general informational purposes and does not replace individualized professional medical advice.
Clinical decisions are made by the licensed healthcare professional responsible for your care.
Lunera Health does not guarantee treatment eligibility, issuance of a prescription, prescription of a particular medication, pharmacy fulfillment, continued medication availability, or any particular treatment result.
Individual treatment results vary.
10. MEDICAL RECORDS & CLINICAL INFORMATION
Medical records and clinical documentation created in connection with clinical care are maintained under the responsibility of the applicable professional medical entity in accordance with applicable law.
Lunera Health is not responsible for creating clinical diagnoses, treatment plans, clinical notes, or other medical documentation.
Requests concerning clinical medical records may be directed to the professional medical entity responsible for your care.
Lunera Health may receive limited information necessary for non-clinical purposes such as customer support, billing, consultation status, prescription fulfillment, and shipping.
For information regarding Personal Information collected by Lunera Health, review the Lunera Health Privacy Policy.
11. LABORATORY & DIAGNOSTIC SERVICES
Where applicable, a healthcare professional may determine that laboratory or diagnostic testing is appropriate.
Independent laboratories or other appropriately qualified third parties may provide these services.
Lunera Health does not independently interpret laboratory results, diagnose medical conditions, or make treatment decisions. Clinical interpretation remains the responsibility of the healthcare professional.
12. ACCEPTABLE USE
You may not use the Platform for unlawful, fraudulent, deceptive, abusive, or harmful purposes; provide false identity or medical information; impersonate another person; fraudulently seek prescriptions; interfere with Platform security; obtain unauthorized access; introduce malicious software; scrape the Platform through unauthorized automated means; misuse payment or communication systems; or otherwise violate applicable law or third-party rights.
Lunera Health may restrict, suspend, or terminate access for violations of these Terms.
13. INTELLECTUAL PROPERTY
The Platform and its software, technology, designs, text, graphics, logos, trademarks, interfaces, and other materials are owned by or licensed to their respective owners and protected by applicable intellectual-property laws.
You receive a limited, personal, non-exclusive, non-transferable, revocable right to use the Platform for its intended lawful purposes.
Unauthorized copying, reproduction, modification, distribution, reverse engineering, decompilation, sale, licensing, exploitation, or creation of derivative works is prohibited except as permitted by law or authorized by the applicable owner.
14. THIRD-PARTY SERVICES
Independent third parties supporting the Platform may include professional medical entities and healthcare professionals, pharmacies, laboratories, payment processors, shipping and fulfillment providers, technology providers, and other service providers.
Third parties may maintain separate terms, privacy policies, professional obligations, and legal responsibilities.
Lunera Health does not control healthcare professionals’ independent clinical judgment, pharmacists’ professional judgment, or independent third-party operations.
15. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE LUNERA HEALTH PLATFORM AND NON-CLINICAL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
Lunera Health does not warrant uninterrupted, error-free, completely secure, or continuously available operation.
Lunera Health makes no warranty regarding medical outcomes, prescription approval, medication availability, or treatment results.
Nothing herein excludes rights or warranties that cannot legally be excluded.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Lunera Health and their owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform.
Lunera Health is not responsible for healthcare professionals’ independent clinical judgment or the independent professional activities of pharmacies, laboratories, shipping providers, or other third parties, except where liability cannot lawfully be excluded.
To the extent permitted by law, aggregate liability arising from your use of the Platform or Services will not exceed the amount you paid to Lunera Health for the applicable service during the six (6) months preceding the event giving rise to the claim.
17. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless Lunera Health and their owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from misuse of the Platform, violation of these Terms, knowing provision of false or fraudulent information, violation of law, or infringement of third-party rights.
18. SUSPENSION & TERMINATION
Lunera Health may restrict, suspend, or terminate access for violations of these Terms, fraudulent or abusive activity, materially inaccurate information, legal or security risks, or discontinuation of applicable services.
Healthcare professionals independently determine whether to initiate, continue, modify, or discontinue clinical care.
Pharmacies may independently decline to fulfill prescriptions.
Termination does not eliminate payment obligations already incurred.
19. GOVERNING LAW & VENUE
These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute not otherwise resolved will be brought in the applicable state or federal courts located in Palm Beach County, Florida, unless applicable law requires otherwise.
20. CHANGES TO THESE TERMS
Lunera Health may modify these Terms from time to time.
Revised Terms will be posted through the Website and the “Last Updated” date will be updated.
Continued use following the effective date of revised Terms constitutes acceptance to the extent permitted by applicable law.
21. GENERAL TERMS
If any provision is determined to be invalid or unenforceable, the remaining provisions remain in effect.
Failure to enforce a provision does not constitute a waiver.
These Terms, together with incorporated policies and applicable consents, constitute the agreement between you and Lunera Health regarding your use of the Platform.
